so i just got my new 3pm and got a hitec servo.
it has something like 51 for the torque number
it seems to me that it struggles a little bit with the throttle return spring but the brakes seem to work fine.

is there a recommended torque rating that you need for throttle?

edit: btw i never had this problem with my rappy futaba s3003 servo and its only rated 3 higher

I never had much trouble with the throttle/brake servo, even as a RTR.

There's very little load on a throttle servo till you add a return spring. Maybe you have more spring than you need.

anyless spring and the spring doesn't pull the brake on

You don't want to pull the brake on, you just want to pull the throttle off in case of a problem.
The way it sounds, when you let off the throttle, the car won't coast, but will engage the brakes. That's way too much.

no i mean its the least amount of str it has to be able to even turn the servo
