I got a pull start for my Hyper 8 port and put it on. Before I installed it, I gave it a pull just to double check it before I fully installed the engine, and I think the rewind is broke and was broke from factory. I didnt over pull it or anything and it happened on the 1st pull. Is there anything I can do or am I screwed and have to just buy a new one, and eat the cost of the defective one?? Just thought Id ask some opinions.

why don't you just re-wind the spring
The rewind spring isn't that difficult. It just takes patience and eye protection... stupid spring! There aren't many parts in there. 3 or 4 pieces make up a pull start.
You may have just had the end come disconnected. That happened on my omega 21 comp engine the second time I started it during break in. Talk about disapointing. It was in a 21 maxx. I took it home and was back out continueing break in about 45 minutes later.

I wouldn't say that I am a master at it, but I am pretty darn good with fixing them. I just did one for Domination (CLICK HERE to read the thread). I think he was without it for maybe five days. He sent to me, I repaired it on arrival, and had it in the mail the next day.
If you can't get Tower to do anything, let me know...
As for this particular pull start, I have quite a bit of experience with it. Drop me a PM if you want me to have a go. The only charge is shipping (you cover both ways) as long as the pull start and its parts are in good condition. If I have to replace any parts, I may send you a bill...but from the sound of it...everything is brand new.

And I'm really questioning the servos now, they seem kinda still for some reason. I just got a pocketbike so I've just been taking a break from working on it, because I've been getting really frustrated with it. I even thought about just dropping it off at a LHS and telling them to finish it..lol... I'm sure thatd cost me a grip. Now I just gotta order some steel gears for in the tranny. (The 2.5' and Pro 15 old skools have the same trannys/gears?) and I need one of them "Cup" thingys to go on the ball on the slide carb. So thats about it and were I'm at. Its gettin there, slowly but surely. My luck Ill get it finished the day it starts snowing..lol..
