While I agree that he should not have to register as a sex offender, I do not agree he should get away scott free. I think a misdemeanor battery charge would be about right. The article seems to be a bit one sided. The article does not disclose where the girl stepped into the road. Was she jay walking?? Or was she in a cross walk? What time of day was it? (was it getting dark). How much attention was the driver paying to pedestrian traffic? Was she on a corner or cross walk? What was the speed limit and was the driver compling with the posted speed limit? And if so was it appropriate for the conditions at the time? etc, etc, etc and dozens of other questions that may have some relevance.

What the article did reveal is that the defendant did grab her. On that note, how violent was the "grab". Did she try to pull away and he restrain her? Was there bruising? Was he calming talking to her or screaming in her face? How big was the defendant. Was he 6'4" and 350 lbs? Would a reasonable person of the plaintiffs experience and stature have been in fear?

I know even at my age if some man jumped out of his car and grabbed my arm to "lecture" me for any reason, even if I was in the wrong, it would frighten me. I can't imagine how scared a 15 year old girl would become.

I don't know about IL law, but another thing the article does not mention, is how long he will have to register as a sex offender. Most states have varying lenghts depending on the charges, prior offenses, etc. Also, if it is a first offense and a misdemeanor, then after a few years you can have your record expunged.

Again, I do not agree with him having to register as a sex offender, however, before we blast the girl or the parents, it seems that we should have all the facts.

Sounds like you have some handcuff experience Eddy. I don't think that recreational use of handcuffs on yourself is a crime unless you didn't consent..........LOL

Plaid, like your attitude. As you say, not all people of one party or another are the extremes. I vote Republican, but really I am more of a Libertarian, but without numbers, I cannot comfortably join that party knowing my vote will have little impact. This leaves me with little choice in my quest for a smaller Federal government.

As to Fed law over State law, note we are a Federal Republic of States, governed by a central, Federal Government, that originally was intended to only have limited poowers, in essence, only those as framed in the Constitution of the United States. Each state would have State's rights and their own Constitution. In order to keep chaos from ensuing, the originators of our Fed Constitution permitted an Amendment allowing the full faith and credit portion to be part of our Constitution. In other words, your Texas Driver's License will be accepted in Ohio as ID and allows you the right to drive there while visiting or passing through, and so it goes.

Never was it intended that the US Constitution would be the only law, but due to the flurry of lawsuits starting in the late '50's to the present, case law has now shaped our lives. We should all make ourselves more aware of how case law can affect us, and then go to the ballot box in the hopes of getting local legislation that supercedes some of this bad case law, but, as noted above, people will watch a re-run, for the third time, of Married With Children before they will take the time to raise their awareness of the law, laws passed and what to vote.

As to the this girl who sued, I feel bad for the driver. He took more punishment than the law really intended, but again we were not all there, so maybe there is more to the story. Sad to see how ridiculous this all has become. What ever happened to individual responsibility?!?

Its a good discussion. There is a lot involved with this topic. It reaches down to the root of good and evil. Keep it going. The only other alternative is to chat with WyldSeaMaiden. She gives good PM :D
