If it always seems to be in gear it sounds like your idle is to high, because with FOC the tranny is always in gear but won't move until the clutch bell is engaged to the spur gear which only happens when the motor is turning enough RPM's to make clutch grab the clutch bell, so if you lower your Idle a little bit it the clutch shouldn't grab the bell any more unless your clutch is not working properly, like worn out clutch springs or something of that nature...
