Well i had insurance, and most will be covered. I have an alarm and i had an apointment this saturday to put it in, go figure. The cop pissed me off cause he didnt do his job for one, and 2 he was an ass to me and my family.(i dont take that lightly). Iv know my buddy since kindergarden so i i dont think so. He went out, and came back in like 3 min. (no way he could of done it) and if he was in on it, then he would not immediatly come and get me, pulled me outta my chair, and drug me to my car....trust me, it wasent him!
 
Yeah I wasn't accusing anyone, just wanted to mention it because I see it so much. I know what you mean about the cops. There's a couple that I like, one of them is a friend of mine and a member here, but for those couple that I like, there are thousands of power hungry assholes that became cops because they got picked on so much as kids, and they want to take out there misery on anyone that crosses their path. I know there are a lot of good ones out there, and they work hard to keep us safe,and I REALLY appreciate all of the good things that they do. But my experience here in Louisiana, especially with the older cops that I know, has been that cops get involved in the politics, and they forget that they're still cops.

When I was in high school, I was driving a mistubishi because someone wrecked my other car and it was available for my price range. Well I finally saved up enough money and found an absolutely BEAUTIFUL nova that I wanted to buy, had a 383 stroker in it. Much more my style than a 4 year old mitsubishi mirage. I worked out a deal with the car lot because they wanted to trade me for my car, because it was in such good condition. So I get it all cleaned up and do all the paperwork, and wait for the day to go by at school. Well I had to meet with a teacher after class (go figure) and when I got out to the parking lot, the whole side of my car was bashed in. The trade in value was shot, and I didn't have 2500 to go fix it real quick and then make the deal. Anyway, had to save up for about a year because of some prick. When I saw the damage, I called the police to report it, knowing that the person would be parked in the parking lot the next day with red paint all over their bumper and fender. The cop rode up on his motor cycle, handed me a piece of paper to fill out for the insurance company (didn't have full coverage, couldn't afford it in high school), and rode off saying he couldn't do anything in a parking lot.

A few years later, I had a really nice 98 Dodge half ton pickup that I was giving the hot rod treatment to. It was painted flat black, lowered about 8 inches in total with tires and suspension. Had a nice cam in it, set of headers, mopar performance intake manifold, mopar performance heads. Anyway, I had a party at my house on night and for a reason that is still unknown, after the party a kid came back and broke out the windows of my truck and put a few small dents in it. I had just inherited it after Dad passed away. In fact, he put the lowering kit on and the heads. Anyway, I was crushed. I found out who it was, filed a police report, and went downtown to get some action taken. Of course, being into hot rods I knew that the kid had just made one of the biggest mistakes of his life. I went to a few boddy shops that my buddies own and got some 12,000 estimates to fix the truck. In court, I claimed that the truck could not be totaled out because of sentimental value so I wanted to keep it. The judge gave the guy the option of admitting his guilt and paying full restitution, or going to trial on those and several other charges where he would eventually get some serious time. It took him a few years paying 300 a month, and then he stopped paying. I called the DA and told him to lock the SOB up if he wasn't going to pay, and I got a check for the last $4,000 2 weeks ago. Moral of the story, you mess with my rides and you will get hurt, rather it's financially, or me having to hunt down your family members with heavy artillery. lol j/k.or am i?
 
Forcing these idiots to make full restitution is the greatest punishment there is.
When the legal system starts to do this with car thieves and joy riders, instead of shrugging it off to the insurance companies, our insurance will drop in half. When these idiots get caught after trying to outrun the cops and wrecking the stolen ride, and then go to court and find out they owe someone 20 grand in damages, it will finally stop.
 
Sort of a different story but on the same lines?

Dad sold a tandem dump truck to a guy on payments. Not been paid for yet. He had a lawyer starting on it before he passed away. (he has been gone a little over a year)
I went with Mom to court over it twice. Once in Oct. and once in November?
Last time the guy didn't show, so there is a warrant out on him.

The deadbeat hasn't went to jail yet. Mom hasn't seen a dime of her money. As far as I know he is still working the truck every day. She is out 2 grand for a lawyer. I called and tried to talk to the judge a while back. According to his secretary, since there was a lawyer involved, the judge can't talk to us unless the lawyer is there. Ain't that some sh....?
 
If he was to pay it off, you should still have the title, and the right to put an immediate lien against the truck, and revoke the right to the current registration on it. At that point, you either get your money or your truck.
I think the lawyer is just sucking you along.
 
Yeap Rolex is right, you should be able to Lien it, but your Dad might have signed the title over to him to help out a person in a bind. If you lien it and the registration gets pulled, when he gets pulled over they can take the truck, and he will go to jail if that warrant is still active.
 
You need to find whatever papers your father left behind that pertained to the truck. Either the title, or receipts, or some type of contract in writing.
You have LEGAL RIGHTS, and basically the guy is now driving a stolen truck.
Get the truck back, and park it on your lawyer.

I'm kinda in the middle. It's Mom's truck. Gotta have her with me when I do anything. But I have to help her get it back. May try to ride down there this weekend. I could sell it pretty quick if he hasn't tore it up.
 
I sure could use it to haul dirt for the track! Diesel is getting so expensive, so i might just have to do a really BIG brushless conversion lol. All joking aside, I hope things work out Digger.
 
Well, this is an interesting situation. Since your father died in the midst of the transaction, and you hold the title in your father's name, I think it's something that needs to go before the probate judge, since this is property that's part of the estate.
You also need to ask your dip poop lawyer why he didn't just send the guy a bill on a legal letterhead telling him he was in default of the contract, either written or verbal.
He has defaulted on the loan, and the estate has the right to repossession of your father's property.

I don't know the whole story, but if it were me, I would fire the blood sucking attorney you have, and then go back to the judge, explaining the current situation. If it goes through the probate judge, he will probably issue a writ of possession, you'll get your truck back, and you can then sue the guy for any damages and wear and tear to your father's unpaid vehicle.

if your lawyer wasn't such a turd hed brought up the fact that if this truck is involved in an accident, weather on or offroad, the legal owner of the truck is responsable!

if you have the title, go get the truck. i sold a s-10 blazer that i had lowered and smallblocked and the tard i sold it to failed to register it,he was scared as hell of the truck so he sold it to one of his buddies. since the title was still in my name and he wasn't the guy i sold it to they wouldnt register it to him,so he goes back to the county annex and tells them he is me and needs to renew his tags. just to tag it so he can drive it, he drove it for a year and when the tags were about to expire i get a renewal in the mail, i shrugged it off at first then noticed that it had been taged to me the previous year and it was a different tag # from what i had on it so i started getting suspecious. called the annex and spoke with a lady who informed me that i still had a white chevy suv registered in my name, called the guy i sold it to and asked if he had done this and he said no and told me who he had sold the truck to, contacted him and he denied doing it also so i start getting pissed. contacted a lawyer to see what rights i had if any and he tells me to GO GET THE TRUCK. and the cops would assist if needed. he said i was liable for this vehicle as long as it is in my name, so instead of going and getting it i gave the guy the option to surrender it or i would be there with the cops. it was in my driveway an hour later. i left it parked until it was out of my name which required me to have to do some work. he got off lucky, i could have just kept the truck and done as i wished but he came clean with the real story and seemed to really be tore up over it so i let him have it back for a small fee for my time and effort.

Estate has already been settled.
Lawyer has kinda done his part. Sent registered letter's than got it before a judge. First time in court the guy showed up. Supposed to have returned the truck within 10 days, paid Mom 2 grand within 30 days. Never saw either.
He didn't show up the next time for court. There is a warrant out for the guy right now. DAMN! for about 4 months! Thought at first the police might actually pick him up and he would have to do something. Guess that is what I get for having a small amount of faith in the justice system.

I have been really busy with other things. Not really had the time.
Gonna try to ride down this weekend.
 
Get a copy of the warrant before you go, then go to his local sheriff's department and ask why they haven't served the warrant yet. (It's usually the sheriffs that serve the warrants)

Was planning on taking the title with me. Getting the state troopers to pull up the warrant on the computer.

Do ya think they will help?

Whatever you do, don't leave that title with ANYONE. You make sure you keep it in your possession. If the police want to hold it, have them make a copy for themselves, and get the original title back.

AJ, I wasn't aware of your long running background with your buddy, I apologize for what I posted earlier, it's just all too common for that scenario and people refuse to look at the person in thier face.....

no that is what you get for thinking we HAVE a justice system...Justice was raped and left by the roadside to die many moons ago friends...We live within a legal system....adjudication has been replacedf with hipocracy, legalities have replaced Honor and truth has been hidden from everyone....If you have the money you can buy truth and recycle it til it meets your needs...fro every law on the books there is another condradicting it....you just have to find a lawyer with no shame (hard find I'm sure) about spending 100s of hours to find the law you need to fit your case....

I had a friends 80cc honda 4 stroke bike I fixed for his kid....the day we got it runing I chained it to my dads boat trailer (had my car so I couldn't bring the bike home)....a neighbor heard from another neighbor's group of friends they were going to steal the bike that night.....my dad already heard this and put 2 more chains on it....came back teh next day and it was stolen....called the neighbor, he came over and spoke with thcops, he even knew the thieves address.....cops told us not to contact them they would take care of it....they didn't even go to the house....didn't file for the warrant or anything.....

I have stopped filling report after that....I understadn the police are not a full staffed force for one man to a case, but when I basically handed them the case and they just file it under the "G" folder, it shows me the truth....we should all be responsible for our own.....I have taken that responsibility myself many times and hope I never get the legal end of the system giving me yet another F*#k You......
 
RamTech had an HPI Baja 5b that they had fully decked out as one of their prototype models. There's is no telling how much money went into this thing in regular off the shelf retail parts, but that was only a very small portion of what was stolen. I mean just the wheels and tires were $500. But here's the kicker, this was the RamTech prototype 4 wheel drive baja. They had been workong on this design for a LONG time and there's no telling how much time and effort went into developing the technology for a 4 wheel drive baja, and then the cost of building the parts and figuring out how to get it all together. They went to the track where RamTech was doing some testing and ran and grabbed it out of the tent or trailer and jumped in their car. This hurts all of us because now it will be that much longer before a 4 wheel drive kit is on the market, and the more stolen parts, the more overhead a company has, and the more overhead, the more their products cost.
 
I just wanted to speak on the police officers defense. As stated, fingerprints mean almost nothing now-a-days with these petty (doesn't seem petty to the person its happening to, but in the real view it is, sorry) crimes such as a smash and grab, or something like this, especially when no one is in danger. First off, the prints have to be on file, second off: a car, sitting in a high school parking lot, with hundreds of kids walking right next to it, leaning on it, anything, you could have up to thousands of different fingerprints on it. The cop might have had a little attitude, but he has probably listening to other peoples B/S problems all shift, and really just didnt care. Rule #1 i learned when i first started, DONT TAKE ANYTHING PERSONALLY. Its his job to take a report, not b a personal crying post. Hate me if you must, but this is the crap that i see every day, and am sick of hearing people bitch and complain about how we do our job, u dont like it, u try and do it. One month is all it will take to get your mind right about how and y we do things.
 
I think most of the problems that people are so sick of in the criminal justice system aren't with the police officers themselves, but with the judicial system and politics. Alpine I hear what you're saying and that's why I made special reference to you in the post. The police officer's that I have problems with aren't the ones that have a bad attitude, it's the ones that use their power to do harm, so called "dirty" cops that break the laws instead of enforcing it. I have a lot of respect for police officers in general and the work that they do for almost no pay. I think we need to have a serious look at the judicial system. When I got arrested in a dope bust, it was potentially a big dope bust but they only found a few grams and some chemicals, not much evidence like they were hoping for. They just didn't find most of the stuff. Anyway, after being locked up for four months and on house arrest for a year and a half just waiting on an arraignment, we finally got around to the court process. The DA was trying to give me a 20 year sentence so I would have to do a mandatory 10 or 12, something like that. Now I'm not saying that what I did was ok, but I think that they should look at sentencing overall. I can rob someone with a gun or commit manslaughter and get off with a few years. But they're handing out 20 and 30 year sentences for non violent charges like drug charges. I'm not arguing that the drug sentencing is too harsh, I know what I did was wrong, I dealt with it and moved on with my life. Just so you guys will know, I'm in no way affiliated with that lifestyle anymore. When I was arrested I gave my life back over to the Lord and have been clean since that day, which is why I'm not in prison now. Anyway, I think that the violent crime sentencing should be at least as harsh as the dope charges.
